QRant: Why is the Man Who Threatened Kanhaiya Kumar Still Free? 

Is there a double standard when it comes to police action for hate speech?

Adarsh Sharma, President of something called the Purvanchal Sena, offered 11 lakh rupees to anyone who killed Kanhaiya Kumar. Kuldeep Varsheny, BJP Yuva Morcha leader from Rewa in MP, offered six lakhs to anyone who cut out and brought him Kanhaiya’s tongue.

Under section 116 – false statements intended to create hatred between communities – and under section 505-506 of the IPC – abbettment to a criminal act – both cognizible and non-bailable offence – BOTH Adarsh Sharma and Kuldeep Varshney can be charged and arrested by the police.

They could be kept in custody as their public statements pose a very real threat to Kanhaiya’s life.

But while Adarsh Sharma has been arrested by Delhi Police, Kuldeep Varshney has not even been charged. He has only been suspended from the BJP for six years.

Kanhaiya spent nearly a month in lock-up, was beaten up in public not once, but twice and labelled a desh drohi based on doctored videos, and spurious witness statements.

The law is supposed to be blind, right? Supposed to be applied equally? Has that happened here?

Rajnath Singh sir, you are the honorable Home Minister. Just want to ask, since when did we have two IPCs?
