The Supreme Court on Wednesday put restrictions on the publication of pictures of politicians in Government advertisements. The top court however allowed the use of pictures of Prime Minister, President and Chief Justice of India.
Only pictures of the President, the PM and the CJI can be published in Government advertisements.

Wednesday’s verdict was based on a case filed by lawyer-activist Prashant Bhushan and his NGO which sought strict rules to check those in power from using taxpayers’ money to gain political mileage.
The court said that any ‘linking of personalities with social benefit schemes is antithesis to democracy.’
Pictures of any chief minister and other political leaders cannot be published in government advertisements

The Apex Court added that the Government can’t be allowed to use public money for unproductive purposes like issuing advertisements for political gains.
The top court also directed the Centre to appoint a three-member Ombudsman to ensure compliance with guidelines and keep check on public advertisements.
However, the SC didn’t impose any curbs on ads issued six months prior to elections if the Govt adheres to the latest guidelines. It also noted that there is no need to conduct special performance audit since a machinery and rules are in place.
