3. HC Refuses to Quash FIR Against Man Accused of Raping Daughter

The Gujarat High Court refused to quash an FIR filed against a man for allegedly raping his minor daughter, a student of class XII, who was residing with him due to a matrimonial dispute between her parents.

Despite the fact that he had successfully 'coerced' his daughter to file an affidavit stating that they had arrived at a ‘compromise’ and the FIR be quashed, the court refused any relief to the man. Instead, a fine of Rs 10,000 was imposed on the man and did not even allow his advocate to withdraw the petition.

The court held that the victim was a minor and is not competent to give consent for quashing. The court had then posted the matter after two months as the girl was supposed to attain the age of majority by then.

The Gujarat High Court on Friday granted temporary bail to BMW hit-and-run convict Vismay Shah, his newly-wed wife, and four others, who are presently behind bars in connection with a prohibition case. While providing the relief, the court clarified that the accused should not leave Ahmedabad.

The court also issued a notice to the state government directing it to file its reply in the matter by the next hearing of the cases.

Six persons were arrested by Gandhinagar police while they were having a liquor party at a farmhouse on December 26. They had to move the Gujarat High Court after a Gandhinagar court rejected their bail plea.

However, the accused failed to get any relief as three high court judges—Justice Umesh Trivedi, Justice AP Thaker, and Justice VB Mayani recused themselves from hearing the bail pleas.
