Delhi HC Stays AAP Goverment’s Notification on Nursery Admissions

The govt asked private minority unaided schools to accept nursery admission forms using neighbourhood as a criteria.

The Delhi High Court on Friday put a stay on the Aam Aadmi Party government’s notification asking private minority unaided schools to accept nursery admission forms using neighbourhood as a criteria.

“Why do you bring out notification at the eleventh hour,” the Delhi High Court bench had asked the AAP government on Thursday, while taking it to task for forcing private unaided minority schools to admit students using the neighbourhood criteria.

While dealing with issues relating to private minority unaided schools, the court said the government cannot force such institutions to follow the 7 January notification regarding neighbourhood criteria for nursery admissions as it was prima facie “contrary to the constitutional mandate”.

“Why do you (government) bring out notification at the eleventh hour,” Justice Manmohan asked.

“Government baffles me at times. Some time they just pass orders without reading the statutes and judgements (of the Supreme Court on private minority institutes). You cannot bring out notification which is contrary to the Constitution and constitution bench judgements,” Manmohan said.
