Kamakshipalya traffic police station is caught in a tricky situation. The land on which the police station is built is now being claimed by a 42-year-old man. However, police officials have asserted that it has been government land for over half a century.
On October 11, a man named Shivakumar Swamy got into trouble when he came to the police station along with construction workers and said he would build a shed in the compound of the station on Magadi road in Bengaluru, claiming it was his land.
The police alleged that Swamy came there because he had sold the land with “fake papers” for Rs 5 lakh. But now he is facing a case filed by the buyer, who is demanding possession of the land.
Tricky Situation
Asked how he sold the land, Swamy told the police he had enough documents to prove his ownership. He claimed that he held a general power of attorney, which empowered him to sell the land to Nagendra Kamath.
He had bought the land from Kamalamma. Swamy also has a ration card in which the address mentioned is the same as where the police station is located.
Following Swamy’s threats to demolish the station on October 11, the west division police filed a case against him for cheating, house-trespass, use of forged documents, criminal intent to prevent a public servant from discharging his duty, and forgery for the purpose of cheating, under various sections of the IPC.
Cops Deny Allegations
The police claim that the land belonged to the commercial taxes department before the police station was built there in 2003.
Bangalore Mirror quoted a senior police officer as saying, “Plot number 25, located on survey 691 in Ashtagrama Layout, Magadi main road, has officially been the Kamakshipalya traffic police station since August 13, 2003. Before that, it was an octroi tollgate belonging to the department of commercial taxes for nearly half a century. Everything from the electricity bills to the water bills have been paid by the government all these years. Suddenly, along comes this man claiming the land has always belonged to him and he even produced fake documents in court claiming he currently resides on this land, meaning in the police station.”
There is already an ongoing court case regarding the land but the court had no idea that the plot contained a police station, as Shivakumar had lied he was living in it. On October 16, we submitted an affidavit to the court with all the necessary documentation proving that the land has belonged to the government for so long.
