A batch of PILs were seeking a ban on the practices of Triple Talaq, Nikah Halala and polygamy. One of the PILs was filed by Shayara Bano, a woman who was given triple talaq by her husband. The other was filed by a Muslim women’s organisation called the Bhartiya Mahila Muslim Andolan (BMMA).
The five judge bench reached a decision with 3:2 split. While Justice RF Nariman called the practice “unislamic, unconstitutional”, the overall verdict termed the practice a violation to the right to equality. The three judges against the practice also concluded that the issue need not be referred to the Parliament.
