‘Modern Family’ actor Sofia Vergara is facing a bizarre lawsuit filed against her by her frozen embryos.
Her former partner Nick Loeb, who she separated from in 2014, has filed the lawsuit against her on behalf of the two frozen embryos named “Emma” and “Isabella” from pro-life state of Lousiana, where it’s legal for embryos to file lawsuits.
In suit, Loeb asked for full custody of the embryos, terming Vergara as the “egg donor”. He said by not letting them born, his former partner is withholding the right of her future children to attain their rightful inheritance.
Vergara’s lawyer, Fred Silberberg, said that if he wants a family, he could hire a surrogate without dragging Vergara into a lawsuit.
Although Loeb and Vergara have signed an agreement that any embryo could be brought to term with both parties’ consent, if a Louisiana judge dismissed the agreement the Loeb could have a leverage in the lawsuit. In that case, Vergara would have to file a counter-lawsuit from the state of California.
