Subramanian Swamy Criticises Rajasthan Govt’s New Ordinance

The ordinance calls for govt sanction to probe serving & former judges, public servants for on-duty actions.

Senior BJP leader Subramanian Swamy took to Twitter on Saturday, 21 October, to oppose the BJP-led Rajasthan government’s new ordinance that shields judges, magistrates and Babus from getting probed.

Swamy asserted that the ordinance violates the Supreme Court’s 2015 judgement in the Subramanian Swamy vs CBI case.

The ordinance essentially protects both serving and former judges, magistrates, and public servants in Rajasthan from being investigated regarding on-duty action – ie, while acting or purporting to act in the discharge of their official duties – without its prior sanction.

The Criminal Laws (Rajasthan Amendment) Ordinance 2017, promulgated on 7 September, also puts a bar on the media from reporting the accusations till the sanction to proceed with the probe is obtained.
