In an unprecedented special hearing on Sunday, a Supreme Court Bench rejected the plea by the 3-party combine to direct the Devendra Fadnavis government to undertake the floor test within 24 hours, saying this issue would be dealt with only after perusing the two letters.
The apex court said the plea of the post-poll alliance, 'Maha Vikas Aghadi', seeking a direction to the Governor to invite them to form government under the leadership of Shiv Sena supremo Uddhav Thackeray would not be considered for the present.
The BJP was propped up by NCP's Ajit Pawar who revolted against his party headed by his uncle Sharad Pawar. The junior Pawar was made the deputy chief minister.
The top court also issued notices to the Centre, Maharashtra government, Fadnavis and Ajit Pawar on the petition filed on Saturday night by the Shiv Sena-Nationalist Congress Party(NCP)-Congress combine against the Governor's decision to swear in the BJP leader as the chief minister.
After remaining ensconced in his south Mumbai residence throughout Sunday, 24 November, NCP leader and newly anointed Deputy CM Ajit Pawar met Chief Minister Devendra Fadnavis late night and held closed-door discussions.
In a statement late on Sunday, the Maharashtra CMO said the Fadnavis and Ajit Pawar discussed farmers’ distress in the state.

Arguing for the BJP, Mukul Rohatgi says a floor test is required, but that the Supreme Court shouldn't have to get involved as it doesn't have "appellate jurisdiction" over the governor’s decision.
The Supreme Court said that past precedents show that floor tests have been ordered in 24 hours in most cases, where such contentious situation had arisen.

Solicitor General Tushar Mehta, for the Office of Maharashtra Governor asked the court to grant them 2-3 days time to allow them to file a reply.
“The Governor has in absolute discretion invited the largest party on 23 November,” said Mehta.

Amid the political drama over government formation in Maharashtra, deputy CM Ajit Pawar got a clean chit from the ACB in the irrigation scam.
According to highly placed sources in Maharashtra Anti Corruption Bureau (ACB), in the list of cases being circulated on social media, none of the cases belong to alleged irrigation corruption case against Maharashtra Deputy Chief Minister, Ajit Pawar.

NCP supremo while addressing the gathering of MLAs said that it was the responsibility of the party to form government as no party got majority.

Attacking Ajit Pawar for joining hands with Devenra Fadnavis, Pawar said that he has been removed as the leader of the party and has no right to issue whips anymore.
“There will not be any problem in proving our majority. The one who is suspended from the party cannot give any orders. On the day of floor test, I will bring more than 162 MLAs. This is not Goa, this is Maharashtra,” he added.
MLAs of Shiv Sena-NCP-Congress took an oath to “not be lured” and “not help the BJP”.
“I swear that under the leadership of Sharad Pawar, Uddhav Thackeray and Sonia Gandhi, I will be honest to my party. I won't get lured by anything. I will not do anything which will benefit BJP,” the pledge said.
BJP leader Ashish Shelar said that the MLAs of Shiv Sena-NCP-Congress were paraded like criminals.
“Identification parade is done in case of accused persons, not in case of elected MLAs. It is an insult to the MLAs and the people who elected them,” he said.

“We respect Supreme Court's order of carrying out a floor test tomorrow. NDA doesn't have the majority yet, I am sure we will get it by tomorrow as we trust Ajit Pawar that he will bring his MLAs,” said Athawale, amid reports of Pawar resignation as deputy chief minister.
NCP's Jayant Patil asserted that he will comment on Ajit Pawar’s resignation only after “getting to know everything about it.”

We tried to form the government with Shiv Sena, but Shiv Sena realised that their bargaining power increased after numbers, Fadnavis said at the press conference on Tuesday, adding that that's why they started bargaining for things that weren't decided before.
He also said that it was never decided that BJP will give CM post to Shiv Sena and that it had been made clear in every press briefing before the elections.
Shiv Sena threatened the BJP to go with "anyone" if the demands were not met, but in spite of talking to us, they were also talking to Congress and NCP, Fadnavis said, adding that they spoke to everyone but them.
The Governor invited us after the term of the previous government got over, but we didn't have the numbers so we backed off first, Fadnavis said, adding that Shiv Sena couldn't prove its numbers either, which is why President's Rule was imposed.
Three parties were having discussions for over 10 days. It took so long for them to agree because they are not ideological partners, Fadnavis said.
“The hunger for power is such that now Shiv Sena leaders are even willing to ally with Sonia Gandhi,” Fadnavis added.
At the media briefing, Fadnavis said that Ajit Pawar had approached them to form the government in Maharashtra, being the NCP whip. After the SC asked for a floor test on Wednesday, Ajit Pawar came to his house and said that he cannot continue with the alliance, Fadnavis said.
“Now we don't have the numbers. It was always my stand that we will not poach anyone's MLAs,” Fadnavis said. All the NCP MLAs were with Ajit Pawar and that is why we decided to form the government, he added.
The NCP-Shiv Sena-Cong alliance will crumble, Fadnavis said on Tuesday, adding that he was extremely happy with the work BJP has done over the last five years.
“I am satisfied with the trust people showed in us. In the past five years, I worked tirelessly for the state as they gave me the mandate. I thank PM Modi, Amit Shah, JP Nadda, all ministers, MLA, MLCs, my team,” Fadnavis said, adding that they would serve as Opposition party.
Absolving the central leadership of any responsibility for the failure of BJP-Ajit Pawar alliance, Devendra Fadnavis said the decision to ally with NCP supremo Sharad Pawar’s nephew was taken by the party’s state leadership.
“Any decision happens in the state, not at the Centre. The decision to go with Ajit Pawar was the decision of the state leadership. And I don’t think this will malign my clean image. I am who I am and Maharashtra’s public knows it very well. They have accepted me,” Fadnavis said.
“After this I'll go to Raj Bhavan and tender my resignation. I wish them all the best whoever will form the government. But that will be a very unstable government as there is huge difference of opinions,” Fadnavis said.
“I doubt that this three-wheeler government will be stable but BJP will work as an effective opposition and try to raise the voice of people,” Fadnavis added.
“No matter how they were in power, I also thank the Shiv Sena for their support in my first term,” Fadnavis further said.
“We had decided that we will never indulge in horse trading, that we will never try to break away any MLA. Those who said that we indulge in horse trading bought the entire horse stable,” Fadnavis said.
After the press meet, Devendra Fadnavis has left for Maharashtra Governor's residence to give his resignation letter.

Congress leader Prithviraj Chavan said that he has requested Maharashtra governor to accept Fadnavis' resignation and invite Shiv Sena-NCP-Congress alliance to form government, according to PTI.

“What has happened today is the first comma to the manner in which opposition governments have been sought to be toppled by the BJP,” Tewari further said.

Maharashtra Governor Bhagat Singh Koshyari has appointed BJP MLA Kalidas Kolambkar as pro tem Speaker of the Assembly.
"The governor has administered oath to Kolambkar as pro-tem speaker of the assembly. Kolambkar will administer oath to remaining 287 MLAs during the assembly session," said an official from Raj Bhavan.
"What is happening in the country is that rather than protecting the Constitution, the Constitution is being attacked", Congress leader Kapil Sibal said, speaking at a press briefing held by Congress.
Sibal further alleged that the Maharashtra Governor was acting on the advice of Amit Shah, referring to Fadnavis's swearing-in early on Saturday morning.
“They knew they did not have the majority but they wanted more time.The Governor gave them 14 days, so obviously they all were hand in glove. They were hoping that the courts will not interfere,” Sibal further said.
At a meeting of NCP-Shiv Sena-Congress MLAs, Sharad Pawar made it clear that Uddhav Thackeray will be the CM of Maharashtra, NCP's Nawab Malik said at a press briefing. Thackeray has also agreed to this, Malik added.
He said that they would form a strong government.
"Our alliance (NCP-Shiv Sena-Congress) will last for a long time. This is the start of BJP's end, BJP has become very arrogant," Malik said.
A meeting of Shiv Sena, NCP and Congress will take place at 6 pm today, Nawab Malik said. Leaders of Sena, NCP and Congress will hold a meeting and then meet Governor Koshyari, said Malik.
"Till yesterday the BJP was saying that we (Cong NCP Sena) do not have numbers. But after the SC order, they realised their situation and finally Fadnavis resigned. After Uddhav Thackeray is elected as our leader, we will go to the governor to stake claim to form the government," Malik added.
Pro tem Speaker Kalidas Kolambkar said that the first session of new Assembly will begin tomorrow and that at 8:00 am, the oath-taking ceremony of the MLAs will begin.

“SC has upheld the spirit of the Constitution, this is a special news on Constitution Day,” West Bengal Chief Minister Mamata Banerjee said on Maharashtra developments.
“Devendra Fadnavis did the right thing by resigning, he did not have the majority. He should not have taken the oath in the first place before proving his majority,” Mamata further said.
NCP’s Jayant Patil, NCP, ahead of the joint meeting of Shiv Sena, NCP and Congress said that Ajit Pawar will not come for today's meeting.
“There has not been contact with him. But I have been meeting him since 2 days, I will meet him today as well,” Patil said.
Meanwhile, NCP chief Sharad Pawar arrived at Trident Hotel, ahead of the joint meeting.

The alliance will also have a Coordination Committee, Shiv Sena's Anil Desai said.

“We will make this Maharashtra once again that Maharashtra which Chhatrapati Shivaji Maharaj dreamt of,” Thackeray further said.

NCP’s Nawab Malik said that Uddhav Thackeray will soon meet the governor to stake claim on Maharashtra government.
"Uddhav Thackeray was unanimously elected as the leader. He'll definitely be the CM. He'll now go to Raj Bhavan and stake his claim to form government. If the governor accepts the claim, swearing-in ceremony will be held on 1 December at 5 pm at Shivaji Park, the cabinet will also take oath,” he said.

Shiv Sena MP Abdul Sattar said that the priority of the Maha Vikas Aghadi will be to waive farm loans in Maharashtra.
“Our priority will be to waive loans to farmers in the first cabinet meeting itself. Except a few people, rest of the Maharashtra is happy today. I should not be making comments on why Ajit Pawar joined hands with BJP, rest Sharad Pawar can comment on him,” he said.

The Bombay High Court on Wednesday raised security concerns over the swearing-in ceremony of Shiv Sena president Uddhav Thackeray as chief minister at Shivaji Park here, and said holding such functions at a public ground should not become a regular feature.

"What will happen is that this (holding ceremonies) will become a regular feature and everyone will want to use the ground for such ceremonies," the court said.
The high court had in 2010 declared the area as a 'silence zone' after the PIL was filed by the NGO.
Elaborate security arrangements are being made at and around Shivaji Park in Dadar in central Mumbai where Uddhav Thackeray will take oath as Chief Minister on Thursday evening, a police official said on Wednesday.
Senior police officers, including joint commissioner of police (law and order) Vinoy Choube, reviewed the security preparations at the venue on Wednesday, the official said.
"Adequate number of police personnel will be deployed at the venue as thousands of people are expected to attend the event," a senior Shivaji Park police station officer said.

Ajit Pawar on Wednesday said what he did could not be termed a revolt. He also reiterated that he continues to be with the NCP and would abide by whatever party chief Sharad Pawar says.
