Ghaziabad Minor Rape Case: Cops Say No Injury, Father Backs Child

The medical reports have confirmed that the victim did not suffer injuries in her private parts.

The medical test of the seven-year-old girl – who was allegedly sexually assaulted by a class 5 student in the washroom of her school in Ghaziabad – confirms that the victim did not suffer any injuries to her private parts, said RK Singh, Station House Office, Sahibabad.

A police officer investigating the case told The Quint that that the accused had told them that he had had a fight with the girl and even slapped her, but never sexually assaulted her. Additionally, another girl, who had reportedly accompanied the victim to the bathroom, denied such an incident even took place.

Doctor Couldn’t Conduct Medical Test: Father

The Quint spoke to the father of the 7-year-old, who accompanied the minor to the hospital where a medical test was carried out by the doctors on Tuesday, 5 December.

She started crying when she saw the doctor, thinking that she will have to get injections. The doctor said they can’t force her much, and so, they will do whatever best they can.

The case came to light when the victim’s father filed a complaint with the Sahibabad police station In Ghaziabad alleging sexual assault on Sunday, 3 December. A class 5 student allegedly tried to insert wooden stick inside the private parts of a the class 2 student inside the school toilet.

Previous such incidents of crimes against children have largely come from private schools. This is the first recent case to emerge from a government school.

The parents of the victim were made aware of the incident only after a woman doctor discovered signs of assault in the minor’s private parts.

During the investigation, the woman doctor was also questioned by the police. She reportedly clarified that since she hadn’t examined the child properly, she couldn’t confirm that the minor was sexually assaulted.

However, the victim’s father questioned why she said so.

Dr Usha Agarwal broke the news of our child’s sexual assault to us. My child told her everything, the doctor conducted a preliminary medical examination on her and told us that it is a police case. She didn’t give us a medical report then.

The minor’s farther added that the 7-year-old opened up to the doctor because she was scared of talking about it to her parents. He said his daughter wouldn’t lie and they would explore means to get justice.

The incident happened almost a month ago on 8 November inside the school. Initially, when the victim complained of bleeding, her parents took her to a paediatrician, who did not spot anything amiss. Pinning the pain on spicy food, the doctor advised a change in diet.

However, when the pain continued, the victim’s parents took her to another doctor, who found evidence of sexual assault.

According to the FIR, accessed by The Quint, the doctor supposedly took the victim into confidence, who then narrated the sequence of events.

On Monday, 4 December, the victim accompanied by her parents, went to her school and identified the perpetrator to be a class 5 student, in the presence of the principal and other teachers.

The victim’ father, who runs a gas agency, said his daughter was assaulted on 8 November, when students were asked to go back home early due to the smog. At a time when most students had left, a group of children were left behind waiting for their parents to pick them up.

My daughter was huddled in a classroom along with other students, who were all waiting for their parents. The boy, who was also waiting for his parents, followed my daughter to the washroom, where he committed the crime.

We have recorded the statement of the Class 5 student, in which he denied all allegations. We are now waiting for the victim’s medical report.

An FIR has been filed under Section 376 of the IPC, which specifies rape, and Sections 3 and 4 of the POCSO Act.

The school has also launched an inquiry into the incident.
