What Has ‘Victory Crossroads’ Done With Our Maintenance Funds?

Residents only have one question – Where did all our money go?

I had purchased a flat in Victory Crossroads (GSS PROCON Pvt Ltd) at Sector 143B, Noida Expressway by paying 95 percent of the agreed amount in 2012. In July 2015, the builder issued a ‘Presumptive Possession’ letter which said that if we do not take possession of the property by a stipulated date, then there would be a penalty imposed.

So, I had to pay the remaining 5 percent amount and take the possession on a commitment from the builder that within three months, they will get the Occupation Certificate/Completion Certificate and registration of the flat will be carried out. Till date, I am living at the flat without an OC/CC.

The builder, Mr Pramod Goel, who is now in jail, opened a company for maintenance at Victory Crossroads and even charged an advance payment for one year’s maintenance before giving possession of the flats.

For a few months after the payments were made, the builder did provide us maintenance services, but eventually they started defaulting to the extent that the even the maintenance staff started to protest because of non-payment of their salaries.

Residents only have one question – Where did all our money go?

Has it been swindled by the builder? It surely seems so. His wife is a director at the company but given the condition of our case, it looks like she has no authority to do anything and is complicit in what the residents are going through.

Electricity charges are a case in point. We paid for it in advance but we have no idea what the maintenance company did with those funds. Power cuts have become order of the day. They have similarly usurped funds meant for lift maintenance. As a result, lifts remain stuck (if not completely out of order) for long periods and only through our personal liaison do they get repaired.

Since the builder has not paid his dues to the Noida Authority, they haven’t issued a Completion Certificate. As a result, the residents are running from pillar to post to somehow get the flats registered. Fortunately for us, the quality of construction is good and the project is complete in all respects.

Now that the honourable Supreme Court has ruled in favour of the buyers, taking a similar plea, we hope that the UP government will take cognisance of the matter and issue suitable directions to the concerned authorities to resolve this long pending issue. Only this alone can relieve the buyers from their agony.
