Court Dismisses Husband’s Plea that Bobby Darling Is Not a Woman

Bobby Darling had filed a case of domestic abuse against husband Ramneek Sharma in 2017.

A magisterial court in Delhi on Monday, 21 October, dismissed a plea filed by actor Bobby Darling’s husband Ramneek Sharma to not consider her complaint of domestic violence on the grounds that she is “not a woman”. In 2017, Sharma was arrested by the Delhi police after Bobby filed a case of domestic abuse and dowry harassment against him.

Bobby’s counsel Meera Kaura Patel argued against Ramneek’s plea saying that she had undergone a sex reassignment surgery before their marriage in 2016. Her response read, “She (Bobby Darling) is aggrieved as per the definition of ‘aggrieved’ under the Protection of Women from Domestic Violence Act, 2005 as she had undergone a sex change surgery before her marriage to Sharma and is now a woman, which is also mentioned in her Aadhar card and passport”

Patel also cited a Madras HC order of April 2019 saying that it recognised “the marriage between a Hindu male with Hindu transgender woman to be a valid marriage under the Hindu Marriage Act.”

Delhi magistrate Ranjani Ranga observed that as per an order passed after a hearing in 2017, Bobby’s submission that she had undergone a sex reassignment surgery prior to her marriage had been recorded. “The order has not been set aside till date and hence this application is dismissed,” he said.
